It wasn't a criminal offense, it was a civil infraction until and unless there were repeat offenses or false identification used. No different than speeding, not mowing your lawn, etc.

The thing is: it still isn't a criminal offense because you're going to get deported and not thrown in jail. Therefore, you cannot be penalized by being thrown in the penitentiary.

That being said, the law just allows cops to stop you and ask you for your papers. It's a gateway law that moves us closer to a police state, because most cops are retards and this gives them a lot more power to be a lot more retarded.
